Liberty And Justice: Pretrial Practices in Texas

In October, 2016, the Texas Judicial Council's Criminal Justice Committee produced a report recommending the statewide use of validated pretrial risk assessment with the presumption of pretrial release on personal bond for low- or moderate-risk defendants. At the same time, an amendment to the Texas Constitution would allow for high-risk individuals to be held in jail without bail pending due process. This study summarizes research findings evaluating the potential impacts and efficacy of these recommendations.
